Personal injury - employment-related

The NASUWT uses expert solicitors in the pursuit of personal injury claims for compensation which arise out of work-related accidents, illness and assault. As with all personal injury compensation claims, you would need to prove that your injury, illness or disease was caused as a result of the negligence of a third party. The Scheme does not cover medical negligence.

The NASUWT indemnifies the member for all the legal costs incurred, in circumstances where the claim is deemed to have reasonable prospects of success. Casework reviews demonstrate that members consistently receive compensation from their employers’ insurers through Union-backed cases. It should also be noted that accidents which occur abroad, for example whilst on school trips, are only covered where the claim can be pursued in the UK courts.

NASUWT members wishing to apply for legal assistance in relation to accidents at work, accidents during travel between home and work, work-related disease or disability or assault by pupils/parents/intruders will be required to accept the terms and conditions of the Legal Assistance Scheme. These can be downloaded from the Resources box on the right hand side of this page.

You will need to provide your name, contact details and your NASUWT membership number. If there is a problem with your membership or you do not know your membership number, contact the NASUWT Membership Team on 0121 457 6211.

NASUWT members who were not in membership or were three or more months in arrears with their subscriptions at the time of the accident/development of the illness are not entitled to legal assistance and cannot establish entitlement to assistance by subsequently paying arrears. Retired, former, career break and associate members who were in membership at the time the issue arose, and in the case of former members, providing they have not joined another Teacher Trade Union, are also entitled to assistance.
